Ive got a bit of a quandry here. The drain field in my septic system has seemingly failed after just 7 years. I called the local health dept to get some information on repairs and it appears as though the system was signed off on even though it wasnt installed according to the plans. There was a drain that was supposed to be installed to divert any runoff water from going into the drainfield. That could have been the point of failure. Now it looks like im going to be stuck fixing my drainfield and installing the drain. What kind of recourse does a person have against something that was approved which shouldnt have been? Im guessing none.

Find the original contractor, even if the plan was inspected and approved by the local authority the original contractor is still liable. Work out with both the contractor and the local authority, while making your intention very clear to both that you will seek legal advise if satisfaction is not achieved. Document everything of the repair works and the communication with the contractor and the local authority.

Good luck getting the original contractor to pay anything without going to court (if he's even still in business). After all, his work was signed off on by the county/city. The county/city may be able to pressure him by threatening to revoke his bond, but if he's out of business, that won't go far. Maybe the Health Department could help you out with the Inspection Department? But do you want the county/city roads and drainage department ripping up your yard? I had to have my drain field repaired/extended a couple of years ago. Maybe I got a deal, but it ran me $2500.

This is exactly why you should make a copy of the contractor's license, insurance and bond info before the work started. If the contractor is out of business now, you could still go after his insurance policy for error nd omission; if not too much time passed by ( check your local regulation ). The contractor will still be liable for his work even if the work was inspected and signed off by the local authority.

That's nothing...I have to put in a completely new bed in a different part of my property...18 grand plus tax. The original bed should never have been put where it was.
